Terms and Conditions

Effective January 1, 2026

D&R Las Cruces Concrete & Masonry, lascrucesconcreteandmasonry.com, office@lascrucesconcreteandmasonry.com

Agreeing to these terms

These terms cover your use of the D&R Las Cruces Concrete & Masonry website and any estimate or work you ask us for. By using the site, calling us or sending a request through our contact page, you agree to them.

If you don't agree, please don't use the site or book work through it. When you sign a written agreement for a specific job, that agreement controls wherever it differs from these terms.

The services we offer

D&R Las Cruces Concrete & Masonry is a masonry contractor in Las Cruces, NM. Our work includes brick, block and stone work, repair and restoration, pavers, walkways, retaining walls, fireplaces and related concrete work for homes in Las Cruces and the cities around it.

The service descriptions on our home page and elsewhere on the site are general information. They aren't an offer to do a particular job at a particular price. You can read more about who we are on our About page.

Estimates and pricing

We give free estimates at your property, with no obligation to hire us. An estimate is based on what we can see and measure on the day of the visit, so it's our best judgment of the work, not a final bill.

The price can change if the scope changes, if you ask for different materials, or if we find conditions that weren't visible during the estimate, such as hidden damage, poor soil or old repairs behind a wall. When that happens, we'll stop and explain what we found and what it changes before we do extra work. An estimate is good for the period written on it, because material costs and our schedule change over time.

Scheduling, weather and cancellation

We set a start date once you accept the estimate and sign the written agreement. That date is a target, because weather, material deliveries, inspections and conditions on earlier jobs can push it back, and masonry and concrete can't be laid well in some weather.

If we need to move your date, we'll tell you as early as we can and set a new one. If you need to cancel or reschedule, please call us at (575) 222-9031 as soon as you know. Any deposit, cancellation charge or cost for materials already ordered is handled as your written agreement sets out.

Payment

Payment amounts, due dates and accepted methods are set in your written agreement. Larger jobs may call for a deposit before we order materials, with the balance due as the agreement says.

Approved changes to the work are added to what you owe. If a payment is late, we may pause work until the account is brought current, and we may use the remedies New Mexico law allows to collect what's due.

Your property, access and permits

You agree to give our crew safe access to the work area and to tell us about anything we should know, such as buried lines, drainage problems, past repairs or HOA rules. You're responsible for confirming that you own or have the right to work on the area we're building on.

Some masonry and concrete work needs a permit from the city or county where the house sits. Your written agreement will say who is responsible for any permit the job needs.

Workmanship and warranty disclaimers

D&R Las Cruces Concrete & Masonry is licensed and fully insured, and we stand behind our work as your written agreement describes. Any warranty we give is the one written in that agreement, and it covers our workmanship, not the materials maker's product, which carries its own warranty from the maker.

Brick, stone and concrete are natural materials, so color, texture and size vary, and new work may not match older work exactly. Hairline cracks in concrete, white salt deposits on masonry and some settling are normal and aren't defects. Our warranty doesn't cover damage from ground movement, water or drainage problems we didn't create, misuse, other people's work, or repairs made by anyone else. Apart from what's written in your agreement, the website and our services are provided as they are, without other warranties, to the extent the law allows.

Limitation of liability

To the extent the law allows, D&R Las Cruces Concrete & Masonry isn't liable for indirect, incidental or consequential losses, such as lost use of your property or delay costs. Our total liability for any claim about a job is limited to the amount you paid us for that job.

We aren't liable for the use of information on this website. It's general guidance, so check with us before relying on it for your own project.

Settling a disagreement

If something about a job isn't right, call us first, because most problems get fixed fastest when we can come back out and look at them together. Give us a fair chance to put it right before taking other steps.

If we can't settle it between us, we both agree to try mediation in good faith before filing a lawsuit. Either of us may still use small claims court for a claim that qualifies.

Which state's law applies

These terms and any agreement for our work are governed by the laws of the State of New Mexico, unless the law of the state where the work is done requires otherwise. Any court case that goes forward will be filed in the courts serving Doña Ana County, New Mexico, unless that law requires a different place.

Changes to these terms

We may update these terms from time to time, and the version on this page is the one in effect. Changes don't affect a written agreement you've already signed with us.

If any part of these terms can't be enforced, the rest still applies.

Questions about these terms

If you have a question about these terms or about a job, call us at (575) 222-9031 or reach us through our contact page. We respond within 1 business day.
